1. Acceptance of these Terms

By downloading, installing, or using the Driftwink app ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

These Terms are entered into between you and Forgehaven Labs LLC ("Developer," "we," "us," or "our"), the developer of Driftwink.

2. Apple End User Licence Agreement

The App is licensed to you under the terms of Apple's Standard End User Licence Agreement ("Apple EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ . The Developer, not Apple, is the "Licensor" for the purposes of that agreement. The Developer is solely responsible for the App and its content.

These Terms supplement the Apple EULA and govern any areas not addressed by it. Where these Terms and the Apple EULA conflict, these Terms prevail with respect to the App-specific provisions described here.

3. Free tier

Driftwink is free to download. New users receive 3 lifetime story creations at no charge, with no time limit and no payment required. The free tier includes access to the default narration voice and story library for those 3 stories. Story creation beyond 3 requires a subscription.

4. Subscriptions and billing

4.1 Plans and pricing

Driftwink offers the following in-app purchase options:

• Family Monthly: $9.99 per month (auto-renewing subscription)
• Family Annual: $69.99 per year (auto-renewing subscription, with a 7-day free period for new subscribers)
• Lifetime Unlock: $149.99 (one-time non-consumable purchase)

Prices are displayed in the App Store at the time of purchase and are charged in your local currency as set by Apple. Prices may vary by region and are subject to change with advance notice per Apple's policies.

4.2 Free trial (Annual plan)

A 7-day free period is offered to new subscribers on the Family Annual plan. During this period, you will not be charged. If you do not cancel at least 24 hours before the end of the 7-day period, the subscription will automatically renew at the annual price.

4.3 Auto-renewal disclosure

Driftwink Family subscriptions (Monthly and Annual) automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period. You can manage and cancel your subscription at any time in Settings → [Your Name] → Subscriptions on your iPhone or iPad. Cancelling ends your subscription at the end of the current billing period; you will not receive a prorated refund for unused time.

4.4 Subscription features

An active Family subscription (Monthly or Annual) or a Lifetime Unlock includes:

• Unlimited story creation
• Three soothing narrator voices, plus Apple Personal Voice support
• Full saved story library (unlimited stories, playable offline)
• All ambient soundscapes (Rain, Fireplace, Forest, and others)
• All story themes and lengths
• Recurring character cast across stories

4.5 Lifetime Unlock

The Lifetime Unlock is a one-time non-consumable in-app purchase. It grants permanent access to all Family subscription features on the device to which it is tied. It is restorable via your Apple ID. Stories and your settings remain local to each device unless future sync functionality is added. The Lifetime Unlock does not auto-renew and has no recurring charge.

4.6 Refunds

All refund requests are handled by Apple, not by the Developer. The Developer has no ability to issue direct refunds for App Store purchases. To request a refund, visit reportaproblem.apple.com, sign in with your Apple ID, find the Driftwink charge, and select "Request a Refund." Apple makes all refund decisions.

4.7 Managing and cancelling

Subscriptions are managed through Settings → [Your Name] → Subscriptions on your iPhone or iPad. Driftwink does not have an in-app subscription management portal. Uninstalling the app does not cancel a subscription.

5. How stories are created: an honest description

Stories in Driftwink are created using an on-device algorithmic story engine that composes narratives from a library of pre-authored, curated building blocks. Stories are personalised based on the details you provide (your child's name, cast of characters, theme, mood, and story length). They are not written by a human author for each session, nor are they generated by a large language model or live AI chat service. Story content is assembled entirely on your device, with no internet connection required.

5.1 Content safety

Story content is composed exclusively from a curated set of pre-authored, reviewed text blocks. The story engine is structurally incapable of producing inappropriate or unexpected output, because all possible story outputs are bounded by the reviewed building-block library. Every story ends in a calm, safe, restful place.

5.2 Content disclaimer

While all story building blocks are reviewed for age-appropriateness, the Developer makes no warranty that every story combination will be suitable for every child or family. Parents are encouraged to listen alongside their child and use the in-app settings (theme, mood, lesson) to guide content appropriateness.

6. Narrator voices

6.1 Built-in voices

Driftwink reads stories aloud using one of three curated narrator voices that ship with the app: Luna, Wren, and Sol. These voices are built into the App and play on your device. The narrator voices never use the microphone.

6.2 Apple Personal Voice

If you have created an Apple Personal Voice in your device's Settings, you may choose it for narration inside Driftwink. Personal Voice is a feature of iOS that you create and control yourself in Settings → Accessibility → Personal Voice. Driftwink plays it back through Apple's system APIs only; it does not create, copy, store, or transmit your Personal Voice.

6.3 Family Voices

Family Voices lets a family member record themselves reading a story so the child can play it back. Recording is the only feature that uses the microphone, and only while a recording is actively being made. Each recording is stored on your device. Driftwink does not upload it to any server and never clones, synthesizes, or copies anyone's voice. A recording leaves your device only if you deliberately choose to share it, for example through Messages, AirDrop, or your own iCloud backup.

6.4 On-device settings

Your narrator voice choice is stored only on your device as a local preference. It is not uploaded to any server, shared with any third party, or backed up to our systems.

7. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the story building-block content or app assets;
• Use the App or its output for commercial purposes without a separate written licence from the Developer;
• Circumvent the subscription paywall by technical means;
• Use the App for any purpose that violates applicable law.

8. Intellectual property

All story text, in-app illustrations, procedural artwork, and App design are owned by the Developer. "Driftwink" and associated branding are the Developer's intellectual property.

Stories generated by the App on your device are licensed to you for personal, non-commercial use, which means listening and replaying within the App. They may not be reproduced, distributed, or republished without the Developer's written permission.

Any Family Voice recording you make belongs to you and is stored on your device; the Developer never receives, transmits, or claims any ownership of it. If you choose to use an Apple Personal Voice, it remains your own and is controlled entirely by iOS; the Developer claims no ownership or rights over it and never transmits it.

9. Disclaimer of warranties

Driftwink is provided "as is" and "as available" without warranty of any kind. The Developer does not warrant that the App will be error-free, uninterrupted, or that any generated story will meet your specific expectations. Use of the voice-recording feature is at your own discretion. Apple makes no warranties with respect to the App.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use Driftwink, including but not limited to loss of data or voice recordings resulting from device failure, app deletion, or device transfer.

The Developer's total liability for any claim arising from use of the App shall not exceed the amount paid by you for a subscription in the three months immediately preceding the claim.

11. App Store category and Apple compliance

Driftwink is being prepared for submission to the App Store in the Education category; it is not enrolled in Apple's Kids Category. Driftwink is a parent-operated app. Regardless of category, and consistent with applicable law: the App does not engage in behavioural advertising, does not collect personal data from children, and does not include external links from within the App binary (this website is external to the App binary).

12. Apple's role

Apple is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. In the event of any claim by a third party that the App infringes their intellectual property rights, the Developer (not Apple) is solely responsible for the investigation and resolution of such claims. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them.

13. Governing law and disputes

These Terms are governed by the laws of the United States and the developer's principal state of residence, without regard to conflict-of-law principles.

Any dispute arising from these Terms that cannot be resolved informally shall be submitted to the courts of that jurisdiction. If you are a consumer in the EU, you may also be entitled to bring proceedings in your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. Continued use of Driftwink after a change constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page when changes are made. Material changes (such as changes to subscription pricing or new data practices) will be communicated via the App Store update notes.
